  • JIS University (“we”/“Idea-O-Meter”) shall comply with the following policy (“Privacy Policy”/ “Policy”) and the terms of use on the Idea-O-Meter Site (“Terms of Use”) in order to protect your privacy.

    The Privacy Policy and Terms of Use relate to the Idea-O-Meter website (“Site”) and any related services thereon (“Services”).

    By accessing, browsing, registering, logging in and making payments on the Site (collectively “use”), you agree to be bound by the terms and conditions of this Privacy Policy and Terms of Service. If you do not agree, immediately discontinue your use of the Site and any other Services.

    This Policy applies to all such individual persons or groups thereof that submit ideas or content to the Site (“Campaigners”), and such persons who contribute financially for the ideas and make payments on the Platform (“Funders”). The Campaigners and Funders shall collectively be referred to as Users(“you”/ “Users”).

    This policy applies to information we collect from the online registration you may have completed (“Registration”), or in use of the Site, as well as information with respect to any ideas or content you may post on the Site (“Ideas”/ “Content”).

    Any information provided by you is dealt with by Idea-O-Meter as follows:

    1. Idea-O-Meter does not collect personal information unless it is required to be collected for the Site or Platform or for compliance with the law.
    2. Idea-O-Meter does not share your personal information with any third party except in strict accordance with the terms of this Privacy Policy and Terms of Use.
    3. Any personally identifiable information about is stored by Idea-O-Meter is encrypted for storage in our servers and is never shared with any third party in personally identifiable form unless compelled by a governmental or juridical or quasi-judicial authority to do so in writing by way of an order or a warrant.

  • Collection Of Information By Idea-O-Meter

    • We collect information from Users in the following manner:
      1. Information by which each of the User may be personally identified, such as name and e-mail address or any other information input as part of the Registration process which may be defined as personal or Personally Identifiable Information (“PII”) under applicable law.
      2. Information collected when any Campaigner provides content on the Site, and copies and records of any correspondence over email, telephone or any other manner undertaken by any User with Idea-O-Meter, including for any glitches or technical difficulties encountered on the Site or the Services.
      3. Information collected from the Funders while receiving funds and from the Campaigners while remitting the funds over the Site.
    • All Users acknowledge and confirm that:
      2. any personally identifiable Information (“PII”) and other related content which has been provided to Idea-O-Meter, will be used in accordance with sole discretion of the Company subject to the terms of the Privacy Policy and Terms of Use.
      3. that you are the owner of such PII or you have been granted with an approval of use (including in accordance with this policy) from the owner of such PII, whether such PII owned by you or by any third party.
      4. you are not infringing any copyright by providing us with this information.
      5. the information is authentic and verified by you.
      6. you are not a minor, of a legal age and of sound mind to comprehend the policy and to enter into a contract, or you are a legal guardian and aware of your ward entering into a contract.
      7. You expressly consent to collection and storage of all such information provided by you subject to the terms of the Privacy Policy and Terms of Use and any subsequent agreements you may enter into with Idea-O-Meter.

      PII, content posted by any User, and any ancillary information collected due to correspondence with Idea-O-Meter shall hereinafter collectively referred to as “Information” or “Data”.

    • 1.3 You hereby agree and provide explicit consent to Idea-O-Meter to store, use and process your Information and any other Data as per the Terms of Use and Privacy Policy and any other agreement you may enter into to avail the services of Idea-O-Meter.
    • 1.4 Idea-O-Meter assumes no responsibility or liability towards the authenticity of such Information.

  • Usage Of Information

    We use Information collected about you or provided by you or any other third party, including any PII in order to:

    • Provide any User with information that may be requested from time to time.
    • Provide Users with Information relating to accounts, specifically limited to username, email address, funds raised and any other campaign on the Site. This data shall be stored in its encrypted/ anonymized version so that there is no risk of breach of personal privacy and any PII shall not be made accessible to any other User.
    • Post the content posted by a Campaigner in order to raise funds on the Site.
    • Collect and store it as part of the registration and in order to monitor your use of the Site and the Services.
    • Contact any User to ensure that the information we have in our records is accurate or when in need of additional information to complete your profile.
    • Prevent activity we determine to be potentially illegal.
    • Enforce this Privacy Policy and Terms of Use.

  • Protection Of Data

    Idea-O-Meter undertakes the following steps to protect your data:

    • PII shall be collected and stored and secured by means of encryption. Select JIS Group personnel having due authorization shall be allowed access to stored and encrypted PII. PII so stored shall be secured by usage of softwares and mechanisms that is updated and recent with respect to industry best practices ,compliant with reasonable security practices and procedures and compliant with IS/ISO/IEC 27001 on "Information Technology - Security Techniques - Information Security Management System - Requirements".
    • All Information collected and stored shall be protected, secured and encrypted in compliance with the reasonable security practices and procedures.
    • The security practices and procedures are compliant with the codes of industry best practices and procedures and the standard of IS/ISO/IEC 27001 on "Information Technology - Security Techniques - Information Security Management System - Requirements".
    • The security procedures, practices and other security protocols are regularly audited and updated to comply with industry best practices.
    • Any Information provided by you shall not be published or made available in the public domain or for purposes not mentioned in the Privacy Policy, such as marketing, without your explicit consent;
    • The relevant Data you provide shall be stored only for the period of time it is essential on the Site. Data may be stored for a longer period of time in the event of an investigation or otherwise mandated by any Government agency.
    • Any Data and Information shall not be provided to any third party except for the processes required to give effect to the services on the Site and to improve or expand upon the services provided, subject to the Terms of Use. Data shall only be shared with a third party for background services including but not limited to storage, processing, encryption etc. and in accordance with the Terms of Service and this Privacy Policy.
    • In case the Information provided by you violates any law in force, or infringes upon copyright or found to be inauthentic or non-compliant with the Privacy Policy or Terms of Service, Idea-O-Meter reserves the right to suspend all Services being provided and terminate all agreements that you may have entered into to avail Services provided by Idea-O-Meter.
    • Certain Information related to a Campaigner as well as the content posted by such a Campaigner shall be accessible to all registered User for the purpose of raising funds and for the duration of the Campaign. This information shall be specifically limited to username and email address on the Site. You hereby consent to your Information posted on the Site for the duration of the Campaign, and Idea-O-Meter assumes no liability due to any consequence, or breach or violation that may occur due to such publication of Information.
    • Idea-O-Meter shall encrypt and anonymise all Information provided by the User on the Site and all other information such as bank details, PAN or any other PII shall not be accessible to any other User, outside of the specific Information mentioned in the clause above.
    • Further, Idea-O-Meter also uses tools and applications to detect, censor and filter unlawful content. In the event of detection of such content, Idea-O-Meter reserves the right to suspend your accounts, services and terminate any agreements in force.

  • Review And Withdrawal Of Information

    • Any User at any time, may review the personally identifiable information provided to us and alter the same in the event of any inaccuracy or deficiency, by making a request to do so, and Idea-O-Meter shall attempt to rectify any error at the earliest.
    • Any User may also withdraw consent to provide Idea-O-Meter access to all or specific information that the User have consented to provide earlier. However, this is liable to affect the User’s access to the Site.
    • For any request pertaining to review or withdrawal of information, contact the Grievance Officer as per the details provided and as defined in the clause 12 (Grievance Officer) below.

  • Third Parties And Third Party Access To Data

    • By visiting and browsing the Site, you hereby agree to allow Idea-O-Meter to use, store and transfer the data as per the terms of this Privacy Policy.
    • Idea-O-Meter may collaborate with third parties and third party platforms in order to facilitate the services provided on the Site. You hereby provide consent to Idea-O-Meter to share Data with such third parties and abide by the terms and conditions as stipulated by such third parties.
    • All Users are also expected to comply and adhere to terms and conditions and the respective privacy policies of such third parties. Idea-O-Meter is not responsible or liable for non-compliance or breach or any loss caused due to third party actions.
    • Idea-O-Meter is liable to collaborate with third parties for facilitating collection of funds on the platform and remitting them to Campaigners, such as banks or other financial service providers. Any Information related to bank accounts, or any other financial information provided by any User to Idea-O-Meter shall be at the User’s sole risk, and Idea-O-Meter shall not be liable or responsible in any manner whatsoever in the event of any breach or violation due to any action or omission of the respective third parties.
    • Idea-O-Meter shall not be responsible for any compliance or breach on part of the third party organisation beyond reasonable due diligence carried out by Idea-O-Meter.
    • Idea-O-Meter shall not be responsible or under any obligation for any loss of Data or Information, or any Information breach that occurs due to any action, negligence or omission on part of such third parties or third party platforms.
    • In the event that Idea-O-Meter incurs any loss or damages owing to any legal or penal action initiated by third parties, as a result of any action or omission attributable to the User, the User shall be liable to indemnify and hold harmless Idea-O-Meter for any such loss incurred.
    • For any other purpose not covered under the Privacy Policy, Idea-O-Meter shall notify the User on the registered email address and obtain your explicit consent about sharing Data and the User may choose to disallow such sharing. However, this is liable to alter your experience of the Site.

  • Minors

    • Minors under the age of 18 are not allowed to register on or avail of any services on the Idea-O-Meter Site, or browse or use the Site.
    • Users under the age of 18 shall use the Site under the supervision of and with the awareness of a parent or a legal guardian;
    • Idea-O-Meter shall not knowingly and intentionally request Data from an unsupervised minor in any event;
    • In the event you wish to notify us about your child or ward or any other minor using the Site without authorization, you may notify the Grievance Officer using the details provided and as defined in clause 12 (Grievance Officer) below, and prompt action shall be taken to remedy the same.

  • Cookies

    • The Site uses cookies and other similar technologies to distinguish you from other Users of our site. This helps us to optimise your experience of the Site and provide Services. Cookies are non-identifiable, and may be stored on your hard disk if you give your consent. You hereby give your consent to use cookies and other tracking technology.
    • Please note that third parties (including, for example, advertising networks and providers of external services like web traffic analysis services) may also use cookies, which we do not have any control over. These cookies are likely to be analytical/performance cookies or targeting cookies. You hereby agree that we are not responsible for the actions of any third parties.
    • You may block cookies by activating the setting on your browser that allows you to refuse the setting of all or some cookies. However, if you use your browser settings to block all cookies (including essential cookies) you may not be able to access all or parts of our site.

  • Indemnity

    You hereby agree to indemnify and hold harmless Idea-O-Meter, including legal costs incurred, for any dispute, penal or legal action initiated by a third party for any loss or breach caused by your actions.

  • Limitation Of Liability

    • In the event of a breach or loss of Data, Idea-O-Meter shall not be liable to any User beyond the quantifiable value of damages incurred, and only in the event of any action directly attributable to Idea-O-Meter.
    • Idea-O-Meter shall not be liable for any loss incurred on the Platform due to any third party action or omission.
    • In the event any third party initiates legal action for violation or breach of Data or due to trademark, patent, or copyright infringement or any other infringement as a result of any action by a User, the User’s liability shall be unlimited.

  • Governing Law And Dispute Resolution

    • Governing Law: The Site by JIS University and Services by Idea-O-Meter are governed by all laws applicable within the territory of India including the Information Technology Act, 2008 and the Information Technology (Reasonable Security Practices And Procedures And Sensitive Personal Data Or Information) Rules, 2011. By visiting, browsing or in any way using the Site and/or registering for any Idea-O-Meter services you agree to the terms of the Privacy Policy thereby consenting to the exclusive jurisdiction of courts of Calcutta, India, in all disputes arising out of or relating to the use of the Sites or the Privacy Policy.
    • Dispute Resolution: Disputes may be referred to arbitration, which shall then be governed as per the Arbitration and Conciliation Act, 1996. A sole arbitrator shall be appointed by the JIS Group within thirty days of notice of such dispute. The procedure of arbitration shall be governed by the Arbitration and Conciliation Act, 1996. The place of arbitration shall be Calcutta.

  • Alterations And Changes

    Any changes we make to our Privacy Policy in the future will be posted on this page and, where appropriate, notified to you by e-mail or post. Please check back frequently to see any updates or changes to the Privacy Policy and Terms of Use. Continued usage of the Site pursuant to these notifications shall be deemed to be acceptance by acquiescence.

  • Grievance Officer

    • 12.1 The Idea-O-Meter Grievance Officer is responsible for any queries, clarification or comment regarding this Privacy Policy, any other agreement and with regard to Data or Information in general.
    • 12.2 Any such query, specific request, notice or comment should be mailed to grievance@ideaometer.org and we shall address it at the earliest.
